By accessing and using Sitalyze, the AI-powered website analysis service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Sitalyze provides an AI-powered landing page analysis tool that evaluates websites on multiple key metrics including performance, SEO, content quality, design, accessibility, user trust, and more. The Service delivers detailed reports with actionable recommendations to help improve website conversion rates. Our analysis involves:

  • Capturing screenshots of your submitted website
  • Analyzing website performance metrics
  • Scraping public HTML content from your submitted URL
  • Checking domain authority metrics
  • Analyzing content, design, and user experience elements
  • Generating a comprehensive report with scores and recommendations

3. User Accounts

To use our Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information during registration
  • Promptly updating your account information if it changes

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

4. Payment Terms

Sitalyze is offered as a one-time payment service per website analysis. By submitting a website for analysis, you agree to the following payment terms:

  • All payments are processed securely through Stripe
  • Payment is required before the analysis process begins
  • Pricing is as displayed on our website at the time of purchase
  • All payments are non-refundable unless the Service fails to deliver a complete analysis report due to technical issues on our end
  • You will receive access to your analysis report once payment is confirmed and processing is complete

5. Acceptable Use Policy

When using our Service, you agree not to:

  • Submit URLs for websites you do not own or have proper authorization to analyze
  • Use the Service for any illegal purposes or to violate any laws
  • Attempt to reverse-engineer or compromise the Service
  • Use automated means to access the Service without our permission
  • Submit websites containing malware, phishing content, or illegal material
  • Share your account credentials with others
  • Resell reports or Service access without our express permission

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Sitalyze and is protected by copyright, trademark, and other intellectual property laws.

Your Content: You retain ownership of the content you submit for analysis. By submitting a website URL, you grant us permission to access, analyze, and store information about that website solely for the purpose of providing our Service.

Analysis Reports: You may use the analysis reports we generate for your internal business purposes. You may not reproduce, distribute, or publicly display reports without our permission, except as needed for your own business operations.

7. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to the data practices described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Sitalyze provides the Service "as is" without warranties of any kind, either express or implied
  • We do not guarantee that the Service will be error-free or uninterrupted
  • We are not responsible for any actions you take based on our analysis or recommendations
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our Service
  • Our total liability for any claims related to the Service shall not exceed the amount you paid for the analysis

9. Limitation of Service

While our Service provides comprehensive analysis, you acknowledge:

  • Our analysis is automated and based on best practices but may not catch all issues
  • Results are estimates and recommendations; implementation requires professional judgment
  • We cannot guarantee specific conversion rate improvements
  • We may not be able to analyze websites that:
    • Block automated access
    • Require authentication
    • Use technologies that prevent standard scraping
    • Have extremely complex or non-standard implementations
  • Processing may take 5-10 minutes or longer depending on website complexity

10. Indemnification

You agree to indemnify and hold Sitalyze harmless from any claims, damages, liabilities, costs, or expenses (including attorney fees) arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or via email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles.
